Work hours increased

The Devendra Fadnavis-led Maharashtra government is soon preparing to increase the working hours of employees in private institutions to 10 hours per day.

Currently, this limit is 9 hours, but for this change, the state government seems to be preparing to amend the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017. This law regulates the working conditions and rules of employees working in all shops, hotels, entertainment places and other private establishments in the state.

Decision deferred for now

In fact, in the Fadnavis cabinet meeting held on Tuesday, the Labor Department gave a presentation on this proposal. It is said that the issue was discussed, but the ministers sought more clarity on several provisions and their impact. That is, the decision has been postponed for the time being.

The biggest change is related to the working hours. As per the proposed change, no adult employee will be forced to work more than 10 hours on any day, but there are plans to make it ‘normal’ i.e., the work which was previously completed in 9 hours, now employees can be made to work for 10 hours.

Proposal to increase overtime limit to 144 hours

Work hours increased: According to the proposal, the employee will be able to work continuously for 6 hours only if a half-hour break is given in between. Till now the limit of continuous work is 5 hours. Apart from this, there are also preparations to increase the maximum limit of overtime. Currently, 125 hours of overtime is allowed in 3 months, which has been proposed to be increased to 144 hours.

This means that companies will get the freedom to get more work done from the employees. As of today, the maximum working hours (including overtime) are fixed at 10.5 hours, which can be increased to 12 hours and if there is ‘urgent work’, then it has been suggested to remove the limit of maximum 12 hours per day. This means that employees can be made to work without any fixed limit.
