How to file Complaint Under RERA: If you bought a house or flat from a builder and he promised to give you possession in two years, but now five years have passed and the property has not been received yet, then it is a matter of concern. In such cases, many people go through mental and financial stress. But there is no need to panic, you have legal and consumer rights, through which you can get justice.

First of all, it is important to understand that if the builder does not deliver the property on time, then it is a violation of the agreement. The money you have paid has been given under an agreement, and if that agreement is not followed, then you can file a complaint. If your property is registered with RERA (Real Estate Regulatory Authority), then you can complain there. By complaining there, you can ask for your money back with interest. Apart from this, you can also ask for compensation until you get possession.

How to file a complaint in RERA?

Every state has its own RERA website (like UP RERA, MahaRERA). Choose the option of File Complaint or Register Complaint there.

Register online First register yourself on the portal. Fill in your name, mobile number, email and other identity related information.

Fill the complaint form and provide details regarding your complaint:

  • Builder’s name and project details
  • Description of the problem (like not getting possession, construction not being done as promised)
  • When and how much did you pay
  • Documents you have (agreements, receipts, emails, etc.)
  • Upload Documents Scan and upload all the required documents — such as:
    Sale Agreement
  • Payment Receipts
  • RERA Registration Certificate (if available)
  • Pay complaint fee A nominal fee ( ₹ 1,000 – ₹ 5,000) is charged in some states. You can make the payment online.
  • Submit complaint and get receipt After submission you will get a complaint number through which you can track the status further.

Let us tell you that recently Haryana RERA has issued arrest warrants against the directors of a builder because they did not pay compensation to a property buyer on time. The buyer got possession of the property after a long delay of 14 years, due to which RERA had ordered the builder to pay compensation of ₹ 8.6 lakh in 2022. But the builder did not make this payment, after which this strict action was taken. Warrants have been issued against those directors, one of whom is also present abroad.

Apart from this, you can also file a case in the consumer court. If you have suffered deficiency in service, fraud or mental harm, then you can file a complaint under the Consumer Protection Act. In this, you can demand refund, compensation or possession.
