The Delhi government, which is implementing ‘ease of living’ and ‘ease of doing business’ for the people of the capital, has taken another important decision.
Taking a historic decision, the government led by Chief Minister Rekha Gupta has made a special change towards simplifying the process of land registration. Now in most of the cases, No Objection Certificate (NOC) and Land Status Report (LSR) will not be required for land registration.
Giving information about this change, the Chief Minister said that our government has been working continuously for the last five months to make the life of the people of Delhi easy and convenient. During this time it has been observed that the common people have to face inconvenience in matters related to revenue or land in the Patwari, Tehsildar, SDM-DM offices and even where it is not necessary, they have to stand in queues to get NOC.
Keeping this problem in mind, our government has taken a special change. Now No Objection Certificate (NOC) and Land Status Report (LSR) will not be required for land registration.
The Chief Minister said that special measures are being taken to prevent fraud regarding this special change. Gram Sabha, forest land, land under acquisition or prohibited category land will be protected, strict legal action will be taken in case of fraudulent transactions and monitoring will be strengthened through GIS system and Patwari network.
The Chief Minister said that our government is giving priority to e-governance, transparency and citizen convenience. This reform is a decisive step towards transparent and simple land registration in Delhi. This will provide relief to the citizens and eliminate unnecessary paperwork.
Now, NOC/LSR will be required only in limited cases, i.e. only in cases where Section 8 of the Delhi Lands (Restriction on Transfer) Act, 1972 or Section 30 of the East Punjab Holdings (Prevention of Condensation and Fragmentation) Act, 1948 is applicable. In all other cases, no permission from the Revenue Department will be required.
Unless expressly required in law, NOC or LSR will not be mandatory for registration. Sub-registrars will register documents only on legal grounds and documents will be registered as per the conditions prescribed under the Indian Registration Act-1908.
To effectively implement this change, transparency and security have been given priority. For example, a ‘buyer beware’ clause will be implemented, which will ensure that buyers check the status and ownership of the land themselves, information related to the status of the land will be regularly updated on the government portal.
